Terms of Use & End User License Agreement

IMPORTANT - PLEASE READ CAREFULLY. These Terms of Use and End User License Agreement (together, the "Terms") form a legally binding agreement between you ("you" or "User") and the individual developer of Silsilah: Family Tree (the "Developer," "we," "us," or "our") governing your use of the Silsilah: Family Tree applications for iPhone, iPad, Mac and Android and this website (together, the "App"). By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not download, install, or use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and the age of majority in your jurisdiction, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. The App is not directed to children under 13, and we do not knowingly permit their use.

2. Relationship with Apple & Google

Depending on which device platform you use, the App is distributed through the Apple App Store or Google Play Store. These Terms are concluded between you and the Developer only, and not with Apple Inc. or Google LLC. The Developer, not Apple or Google, is solely responsible for the App and its content. Apple and Google have no obligation to furnish any maintenance or support for the App and, to the maximum extent permitted by law, have no warranty obligation whatsoever with respect to the App. Apple and Google are not responsible for addressing any claims by you or any third party relating to the App, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation. Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

3. License Grant

Subject to your continuing compliance with these Terms, the Developer grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on any mobile device or computer that you own or control, solely for your personal, non-commercial purposes. All rights not expressly granted are reserved by the Developer.

4. Your Content & Your Responsibilities

4.1 Your Family Data

The App lets you create and store a personal family tree, including names, dates of birth, photographs, relationships, and similar information ("Family Data"). Your Family Data is stored locally on your device and is not transmitted to, received by, or stored on any server operated by the Developer. The Family Data is and remains yours.

4.2 Your warranties regarding third parties

Family Data frequently concerns people other than you. You represent and warrant that, for every individual whose personal information, name, image, or photograph you add to the App, you have obtained all rights, consents, and permissions required under applicable law (including data-protection, privacy, and publicity laws) to collect, record, and store that information, and that your use of the App does not and will not violate the rights of any person or the law of any jurisdiction.

4.3 Sole responsibility

You are solely responsible for your Family Data, for the accuracy and lawfulness of what you record, and for any dispute that arises among family members or other persons concerning the content you create. The Developer does not review, moderate, verify, or endorse any Family Data and has no access to it.

5. No Reliance - Accuracy & Intended Use

The App is a personal organizational tool provided for general informational and recreational purposes only. It is not a source of verified genealogical, legal, medical, hereditary, financial, or governmental records, and must not be relied upon for any legal, inheritance, medical, immigration, or official purpose. Any face-matching or photo-comparison feature produces only an estimated, non-authoritative suggestion and must never be treated as proof of identity, relationship, or biological descent. You assume all risk arising from any reliance on output of the App.

6. Purchases, Free Tier & In-App Purchases

The App is free to download and includes a free tier. On the free tier you may record up to 30 people in your family tree and share your tree once per day.

Two optional, one-time in-app purchases remove those limits: "Remove Limit" (unlimited people) and "Unlimited Share" (unlimited tree sharing). Neither is a subscription; there is no recurring charge and nothing to cancel.

Who sells them. All purchases are made from, processed by, and billed by Apple (App Store) or Google (Google Play) under that store's terms. The Developer never receives or handles your payment details.
Tied to your store account. An entitlement belongs to the store account that bought it and can be restored on your other devices signed in to that same account. Purchases do not transfer between platforms: a purchase made on the App Store does not unlock the Android app, and vice versa.
Verification. The App asks the store whether an entitlement is active. If the store reports that a purchase is no longer valid - for example after a refund or a chargeback - the corresponding free-tier limit applies again.
Refunds. Refunds are governed solely by Apple's or Google's refund policy and must be requested from them. The Developer cannot issue, approve, or reverse a refund.
Changes. The Developer may change prices, and may change the free-tier limits, for the future. A one-time purchase you have already made remains unlocked; we will not retroactively lock a feature you have paid for.

7. Sharing & Receiving Family Trees

The App can export part or all of your Family Data as an encrypted .silsilah archive protected by an 8-character share code, and can transfer that archive directly to a nearby device over Bluetooth or your local Wi-Fi network ("Nearby Share"). No archive ever passes through a server operated by the Developer.

You choose what leaves and who receives it. You select which categories of people and whether photos are included, and you alone decide who receives the archive and the code. The warranties in Section 4.2 apply in full to everything you send.
The code cannot be recovered. The share code is generated on your device and never transmitted to the Developer. We cannot recover, reset, or bypass it. If you lose the code, the archive is permanently unreadable by everyone, including us, and that loss is your sole responsibility.
Sending is irreversible. Once you have sent an archive, or transferred it to a nearby device, you cannot recall it and the Developer has no ability to revoke, delete, or track it. Anyone holding both the file and the code can read its contents.
Third-party channels. If you send an archive through another service - a messaging app, email, or cloud storage - that service's terms and privacy policy govern the copy it holds. The Developer is not responsible for that service or for any interception, retention, or misuse occurring outside the App.
Receiving. Accept archives and Nearby Share transfers only from people you trust. Imported data is merged into your own tree, and once merged you are responsible for it as your Family Data under Section 4. The Developer does not verify the accuracy, lawfulness, or origin of anything you receive.
Nearby Share visibility. While you have the receiving screen open, your device advertises a display name, a random peer identifier, and your platform to nearby devices, as described in the Privacy Policy. Close the screen to stop advertising.

8. Acceptable Use & Restrictions

You agree not to, and not to permit anyone else to:

use the App for any unlawful, harmful, harassing, defamatory, or fraudulent purpose;
store, record, or share content that infringes the intellectual-property, privacy, publicity, or other rights of any third party;
reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent this restriction is prohibited by applicable law;
copy, modify, distribute, sell, lease, or create derivative works of the App or any part of it;
circumvent, disable, or interfere with any security, authentication, or licensing feature of the App; or
use the App in any way that could damage, disable, overburden, or impair it.

9. Intellectual Property

The App and all of its source code, design, graphics, logos, trademarks, and content (excluding your Family Data) are owned by the Developer or its licensors and are protected by copyright, trademark, and other laws. Except for the limited license in Section 3, these Terms grant you no right, title, or interest in the App.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE DEVELOPER DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF DATA LOSS. NO ADVICE OR INFORMATION OBTAINED FROM THE APP CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR FAMILY INFORMATION, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO THE DEVELOPER FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 25.00 (OR ITS EQUIVALENT IN INDONESIAN RUPIAH).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you; in such cases the Developer's liability is limited to the smallest amount permitted by law.

12. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Developer from and against any and all claims, demands, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the App; (b) your Family Data, including any claim that it infringes or violates the rights of, or has caused harm to, any third party; (c) your breach of these Terms; or (d) your violation of any law or the rights of any person.

13. Data Loss & Backups

Because your Family Data is stored only on your device, the Developer cannot access or recover it. The Developer is not responsible for any loss of Family Data due to device failure, loss, theft, reset, software error, deletion of the App, or any other cause. You are solely responsible for maintaining your own backups - for example your device backup, or an exported .silsilah archive whose share code you have stored somewhere safe. An archive whose code has been lost cannot be opened by anyone, including the Developer.

14. Termination

These Terms remain in effect until terminated. Your license terminates automatically, without notice, if you fail to comply with any provision of these Terms. Upon termination you must cease all use of the App and delete it from your devices. Sections that by their nature should survive termination (including Sections 4–7 and 9–17) will survive.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after a change takes effect constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection rights you may have under the law of your place of residence, you and the Developer agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the competent courts located in Indonesia, and the parties will first attempt in good faith to resolve any dispute amicably before commencing proceedings.

17. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior understandings. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will stay in full force. The Developer's failure to enforce any right or provision is not a waiver of it. You may not assign or transfer these Terms; the Developer may assign them freely. The Developer is not liable for any failure or delay caused by events beyond its reasonable control. These Terms are drafted in English and Bahasa Indonesia; in the event of any inconsistency, the English version prevails for interpretation, except where mandatory local law requires otherwise.

Ketentuan Penggunaan & Perjanjian Lisensi Pengguna Akhir

PENTING - HARAP DIBACA DENGAN SAKSAMA. Ketentuan Penggunaan dan Perjanjian Lisensi Pengguna Akhir ini (selanjutnya disebut "Ketentuan") merupakan perjanjian yang mengikat secara hukum antara Anda ("Anda" atau "Pengguna") dan pengembang perorangan Silsilah: Family Tree ("Pengembang," "kami") yang mengatur penggunaan aplikasi Silsilah: Family Tree untuk iPhone, iPad, Mac dan Android serta situs web ini (selanjutnya disebut "Aplikasi"). Dengan mengunduh, memasang, mengakses, atau menggunakan Aplikasi, Anda menyatakan telah membaca, memahami, dan menyetujui untuk terikat oleh Ketentuan ini. Jika Anda tidak setuju, jangan mengunduh, memasang, atau menggunakan Aplikasi.

1. Kelayakan

Anda harus berusia minimal 13 tahun untuk menggunakan Aplikasi. Jika usia Anda antara 13 tahun dan usia dewasa menurut hukum di wilayah Anda, Anda hanya boleh menggunakan Aplikasi dengan persetujuan dan pengawasan orang tua atau wali sah yang menyetujui Ketentuan ini atas nama Anda. Aplikasi tidak ditujukan untuk anak di bawah 13 tahun, dan kami tidak dengan sengaja mengizinkan penggunaannya.

2. Hubungan dengan Apple & Google

Tergantung pada platform perangkat yang Anda gunakan, Aplikasi didistribusikan melalui Apple App Store atau Google Play Store. Ketentuan ini dibuat hanya antara Anda dan Pengembang, bukan dengan Apple Inc. atau Google LLC. Pengembang, bukan Apple atau Google, yang bertanggung jawab penuh atas Aplikasi dan kontennya. Apple dan Google tidak berkewajiban menyediakan pemeliharaan atau dukungan apa pun atas Aplikasi dan, sejauh diizinkan hukum, tidak memiliki kewajiban jaminan apa pun terkait Aplikasi. Apple dan Google tidak bertanggung jawab menangani klaim apa pun dari Anda atau pihak ketiga terkait Aplikasi, termasuk klaim pertanggungjawaban produk, klaim ketidaksesuaian dengan persyaratan hukum atau peraturan, serta klaim berdasarkan perlindungan konsumen atau peraturan serupa. Apple, Google, dan anak perusahaan mereka merupakan pihak ketiga penerima manfaat dari Ketentuan ini dan dapat menegakkannya terhadap Anda.

3. Pemberian Lisensi

Dengan tunduk pada kepatuhan Anda yang berkelanjutan terhadap Ketentuan ini, Pengembang memberi Anda lisensi yang terbatas, bersifat pribadi, non-eksklusif, tidak dapat dialihkan, tidak dapat disublisensikan, dan dapat dicabut, untuk memasang dan menggunakan Aplikasi pada perangkat seluler atau komputer yang Anda miliki atau kendalikan, semata-mata untuk keperluan pribadi dan non-komersial. Semua hak yang tidak diberikan secara tegas tetap menjadi milik Pengembang.

4. Konten & Tanggung Jawab Anda

4.1 Data Keluarga Anda

Aplikasi memungkinkan Anda membuat dan menyimpan pohon keluarga pribadi, termasuk nama, tanggal lahir, foto, hubungan, dan informasi serupa ("Data Keluarga"). Data Keluarga Anda disimpan secara lokal di perangkat Anda dan tidak dikirim ke, diterima oleh, atau disimpan pada server mana pun yang dioperasikan oleh Pengembang. Data Keluarga adalah dan tetap menjadi milik Anda.

4.2 Jaminan Anda mengenai pihak ketiga

Data Keluarga sering kali memuat informasi orang lain selain Anda. Anda menyatakan dan menjamin bahwa, untuk setiap orang yang informasi pribadi, nama, citra, atau fotonya Anda tambahkan ke Aplikasi, Anda telah memperoleh seluruh hak, persetujuan, dan izin yang diwajibkan oleh hukum yang berlaku (termasuk hukum perlindungan data, privasi, dan hak atas citra) untuk mengumpulkan, merekam, dan menyimpan informasi tersebut, dan bahwa penggunaan Aplikasi oleh Anda tidak melanggar hak siapa pun atau hukum di wilayah mana pun.

4.3 Tanggung jawab sepenuhnya

Anda bertanggung jawab sepenuhnya atas Data Keluarga Anda, atas keakuratan dan keabsahan apa yang Anda catat, serta atas setiap sengketa yang timbul di antara anggota keluarga atau orang lain sehubungan dengan konten yang Anda buat. Pengembang tidak meninjau, memoderasi, memverifikasi, atau mendukung Data Keluarga apa pun dan tidak memiliki akses terhadapnya.

5. Tanpa Ketergantungan - Keakuratan & Tujuan Penggunaan

Aplikasi adalah alat pengelolaan pribadi yang disediakan hanya untuk tujuan informasi umum dan rekreasi. Aplikasi bukan sumber catatan silsilah, hukum, medis, keturunan, keuangan, atau pemerintahan yang terverifikasi, dan tidak boleh dijadikan dasar untuk keperluan hukum, warisan, medis, imigrasi, atau resmi apa pun. Fitur pencocokan wajah atau perbandingan foto hanya menghasilkan saran perkiraan yang tidak otoritatif dan tidak boleh diperlakukan sebagai bukti identitas, hubungan, atau keturunan biologis. Anda menanggung seluruh risiko yang timbul dari ketergantungan apa pun pada keluaran Aplikasi.

6. Pembelian, Tingkat Gratis & Pembelian Dalam Aplikasi

Aplikasi gratis untuk diunduh dan menyertakan tingkat gratis. Pada tingkat gratis, Anda dapat mencatat hingga 30 orang dalam silsilah keluarga Anda dan membagikan silsilah Anda satu kali per hari.

Dua pembelian dalam aplikasi bersifat opsional dan sekali bayar untuk menghapus batasan tersebut: "Remove Limit" (jumlah orang tanpa batas) dan "Unlimited Share" (berbagi silsilah tanpa batas). Keduanya bukan langganan; tidak ada tagihan berulang dan tidak ada yang perlu dibatalkan.

Pihak yang menjual. Seluruh pembelian dilakukan dari, diproses oleh, dan ditagih oleh Apple (App Store) atau Google (Google Play) berdasarkan ketentuan toko tersebut. Pengembang tidak pernah menerima atau menangani data pembayaran Anda.
Terikat pada akun toko Anda. Hak akses melekat pada akun toko yang membelinya dan dapat dipulihkan pada perangkat Anda yang lain yang masuk dengan akun yang sama. Pembelian tidak berpindah antarplatform: pembelian di App Store tidak membuka aplikasi Android, dan sebaliknya.
Verifikasi. Aplikasi menanyakan kepada toko apakah suatu hak akses masih aktif. Apabila toko melaporkan bahwa pembelian tidak lagi berlaku - misalnya setelah pengembalian dana atau sengketa tagihan - batasan tingkat gratis yang bersangkutan kembali berlaku.
Pengembalian dana. Pengembalian dana sepenuhnya tunduk pada kebijakan Apple atau Google dan harus diajukan kepada mereka. Pengembang tidak dapat memberikan, menyetujui, atau membatalkan pengembalian dana.
Perubahan. Pengembang dapat mengubah harga, dan dapat mengubah batasan tingkat gratis, untuk masa mendatang. Pembelian sekali bayar yang telah Anda lakukan tetap terbuka; kami tidak akan mengunci kembali fitur yang telah Anda bayar.

7. Membagikan & Menerima Silsilah Keluarga

Aplikasi dapat mengekspor sebagian atau seluruh Data Keluarga Anda sebagai arsip terenkripsi .silsilah yang dilindungi kode berbagi 8 karakter, dan dapat mengirimkan arsip tersebut langsung ke perangkat terdekat melalui Bluetooth atau jaringan Wi-Fi lokal Anda ("Nearby Share"). Tidak ada arsip yang pernah melewati server mana pun yang dioperasikan Pengembang.

Anda memilih apa yang keluar dan siapa penerimanya. Anda menentukan kategori orang yang disertakan dan apakah foto ikut dikirim, serta Anda sendiri yang memutuskan siapa yang menerima arsip dan kodenya. Jaminan dalam Pasal 4.2 berlaku sepenuhnya atas segala sesuatu yang Anda kirimkan.
Kode tidak dapat dipulihkan. Kode berbagi dibuat di perangkat Anda dan tidak pernah dikirimkan kepada Pengembang. Kami tidak dapat memulihkan, mengatur ulang, atau melewatinya. Jika Anda kehilangan kode tersebut, arsip menjadi tidak dapat dibaca selamanya oleh siapa pun, termasuk kami, dan kehilangan itu menjadi tanggung jawab Anda sepenuhnya.
Pengiriman tidak dapat dibatalkan. Setelah Anda mengirim arsip, atau memindahkannya ke perangkat terdekat, Anda tidak dapat menariknya kembali dan Pengembang tidak memiliki kemampuan untuk mencabut, menghapus, atau melacaknya. Siapa pun yang memiliki berkas beserta kodenya dapat membaca isinya.
Saluran pihak ketiga. Apabila Anda mengirim arsip melalui layanan lain - aplikasi perpesanan, surel, atau penyimpanan awan - ketentuan dan kebijakan privasi layanan tersebut berlaku atas salinan yang disimpannya. Pengembang tidak bertanggung jawab atas layanan tersebut maupun atas penyadapan, penyimpanan, atau penyalahgunaan yang terjadi di luar Aplikasi.
Penerimaan. Terimalah arsip dan transfer Nearby Share hanya dari orang yang Anda percaya. Data yang diimpor digabungkan ke dalam silsilah Anda sendiri, dan setelah digabungkan menjadi tanggung jawab Anda sebagai Data Keluarga berdasarkan Pasal 4. Pengembang tidak memverifikasi keakuratan, keabsahan, atau asal-usul apa pun yang Anda terima.
Keterlihatan Nearby Share. Selama layar penerimaan terbuka, perangkat Anda memancarkan nama tampilan, pengenal peer acak, dan platform Anda kepada perangkat di sekitar, sebagaimana dijelaskan dalam Kebijakan Privasi. Tutup layar tersebut untuk menghentikan pemancaran.

8. Penggunaan yang Dapat Diterima & Pembatasan

Anda setuju untuk tidak, dan tidak mengizinkan orang lain untuk:

menggunakan Aplikasi untuk tujuan yang melanggar hukum, merugikan, melecehkan, mencemarkan nama baik, atau menipu;
menyimpan, merekam, atau membagikan konten yang melanggar hak kekayaan intelektual, privasi, hak atas citra, atau hak lain pihak ketiga;
melakukan rekayasa balik, dekompilasi, membongkar, atau berupaya memperoleh kode sumber Aplikasi, kecuali sejauh pembatasan ini dilarang oleh hukum yang berlaku;
menyalin, mengubah, mendistribusikan, menjual, menyewakan, atau membuat karya turunan dari Aplikasi atau bagiannya;
menghindari, menonaktifkan, atau mengganggu fitur keamanan, autentikasi, atau lisensi Aplikasi; atau
menggunakan Aplikasi dengan cara yang dapat merusak, menonaktifkan, membebani, atau mengganggu kinerjanya.

9. Kekayaan Intelektual

Aplikasi beserta seluruh kode sumber, desain, grafik, logo, merek dagang, dan kontennya (selain Data Keluarga Anda) dimiliki oleh Pengembang atau pemberi lisensinya dan dilindungi oleh hukum hak cipta, merek dagang, dan hukum lainnya. Selain lisensi terbatas pada Pasal 3, Ketentuan ini tidak memberi Anda hak, kepemilikan, atau kepentingan apa pun atas Aplikasi.

10. Penafian Jaminan

SEJAUH DIIZINKAN OLEH HUKUM YANG BERLAKU, APLIKASI DISEDIAKAN "SEBAGAIMANA ADANYA" DAN "SEBAGAIMANA TERSEDIA," DENGAN SEGALA KEKURANGANNYA DAN TANPA JAMINAN APA PUN. PENGEMBANG MENAFIKAN SEMUA JAMINAN DAN KETENTUAN, BAIK TERSURAT, TERSIRAT, MAUPUN MENURUT UNDANG-UNDANG, TERMASUK JAMINAN TERSIRAT ATAS KELAYAKAN JUAL, KESESUAIAN UNTUK TUJUAN TERTENTU, KEAKURATAN, DAN TIDAK ADANYA PELANGGARAN. PENGEMBANG TIDAK MENJAMIN BAHWA APLIKASI AKAN BERJALAN TANPA GANGGUAN, AMAN, BEBAS KESALAHAN, ATAU BEBAS DARI KEHILANGAN DATA.

11. Batasan Tanggung Jawab

SEJAUH DIIZINKAN OLEH HUKUM YANG BERLAKU, PENGEMBANG TIDAK BERTANGGUNG JAWAB ATAS KERUGIAN TIDAK LANGSUNG, INSIDENTAL, KHUSUS, KONSEKUENSIAL, ATAU PUNITIF, ATAU ATAS KEHILANGAN DATA, KEUNTUNGAN, NAMA BAIK, ATAU INFORMASI KELUARGA, YANG TIMBUL DARI ATAU TERKAIT DENGAN APLIKASI ATAU KETENTUAN INI, BAIK BERDASARKAN JAMINAN, KONTRAK, PERBUATAN MELAWAN HUKUM (TERMASUK KELALAIAN), MAUPUN TEORI HUKUM LAINNYA, SEKALIPUN TELAH DIBERITAHU TENTANG KEMUNGKINAN KERUGIAN TERSEBUT.

TOTAL TANGGUNG JAWAB KUMULATIF PENGEMBANG ATAS SELURUH KLAIM TERKAIT APLIKASI TIDAK AKAN MELEBIHI YANG LEBIH BESAR DI ANTARA (A) TOTAL JUMLAH YANG ANDA BAYARKAN KEPADA PENGEMBANG UNTUK APLIKASI DALAM DUA BELAS (12) BULAN SEBELUM PERISTIWA YANG MENIMBULKAN KLAIM, ATAU (B) USD 25,00 (ATAU SETARANYA DALAM RUPIAH).

Beberapa wilayah hukum tidak mengizinkan pengecualian jaminan tertentu atau pembatasan kerugian tertentu, sehingga sebagian ketentuan di atas mungkin tidak berlaku bagi Anda; dalam hal demikian, tanggung jawab Pengembang dibatasi sampai jumlah terkecil yang diizinkan oleh hukum.

12. Ganti Rugi (Indemnifikasi)

Sejauh diizinkan oleh hukum yang berlaku, Anda setuju untuk mengganti rugi, membela, dan membebaskan Pengembang dari segala klaim, tuntutan, kewajiban, kerugian, dan biaya (termasuk biaya hukum yang wajar) yang timbul dari atau terkait dengan: (a) penggunaan atau penyalahgunaan Aplikasi oleh Anda; (b) Data Keluarga Anda, termasuk klaim bahwa data tersebut melanggar atau merugikan hak pihak ketiga; (c) pelanggaran Anda terhadap Ketentuan ini; atau (d) pelanggaran Anda terhadap hukum atau hak siapa pun.

13. Kehilangan Data & Cadangan

Karena Data Keluarga Anda hanya disimpan di perangkat Anda, Pengembang tidak dapat mengakses atau memulihkannya. Pengembang tidak bertanggung jawab atas kehilangan Data Keluarga akibat kerusakan, kehilangan, pencurian, atau pengaturan ulang perangkat, kesalahan perangkat lunak, penghapusan Aplikasi, atau sebab lain apa pun. Anda bertanggung jawab sepenuhnya untuk memelihara cadangan Anda sendiri - misalnya cadangan perangkat Anda, atau arsip .silsilah hasil ekspor yang kode berbaginya Anda simpan di tempat aman. Arsip yang kodenya hilang tidak dapat dibuka oleh siapa pun, termasuk Pengembang.

14. Pengakhiran

Ketentuan ini tetap berlaku sampai diakhiri. Lisensi Anda berakhir secara otomatis, tanpa pemberitahuan, jika Anda gagal mematuhi ketentuan apa pun di dalamnya. Setelah pengakhiran, Anda harus menghentikan seluruh penggunaan Aplikasi dan menghapusnya dari perangkat Anda. Pasal-pasal yang menurut sifatnya patut tetap berlaku setelah pengakhiran (termasuk Pasal 4–7 dan 9–17) akan tetap berlaku.

15. Perubahan atas Ketentuan Ini

Kami dapat memperbarui Ketentuan ini dari waktu ke waktu. Apabila demikian, kami akan memperbarui tanggal "Terakhir diperbarui" di atas. Penggunaan Aplikasi yang berkelanjutan setelah perubahan berlaku merupakan persetujuan Anda atas Ketentuan yang telah direvisi. Kami menganjurkan Anda meninjau halaman ini secara berkala.

16. Hukum yang Berlaku & Penyelesaian Sengketa

Ketentuan ini diatur oleh dan ditafsirkan menurut hukum Republik Indonesia, tanpa memperhatikan kaidah pertentangan hukumnya. Dengan tunduk pada hak perlindungan konsumen yang bersifat memaksa yang mungkin Anda miliki menurut hukum tempat tinggal Anda, Anda dan Pengembang sepakat bahwa setiap sengketa yang timbul dari atau terkait dengan Ketentuan ini atau Aplikasi akan tunduk pada yurisdiksi eksklusif pengadilan yang berwenang di Indonesia, dan para pihak terlebih dahulu akan berupaya dengan itikad baik menyelesaikan sengketa secara damai sebelum menempuh jalur hukum.

17. Ketentuan Umum

Ketentuan ini, bersama Kebijakan Privasi, merupakan keseluruhan perjanjian antara Anda dan Pengembang mengenai Aplikasi dan menggantikan seluruh kesepahaman sebelumnya. Apabila ada ketentuan yang dinyatakan tidak dapat diberlakukan, ketentuan tersebut akan diubah seminimal mungkin, dan ketentuan lainnya tetap berlaku sepenuhnya. Kelalaian Pengembang menegakkan suatu hak bukan merupakan pelepasan hak. Anda tidak boleh mengalihkan Ketentuan ini; Pengembang dapat mengalihkannya secara bebas. Pengembang tidak bertanggung jawab atas kegagalan atau keterlambatan akibat keadaan di luar kendali wajarnya. Ketentuan ini disusun dalam bahasa Inggris dan bahasa Indonesia; jika terdapat ketidaksesuaian, versi bahasa Inggris yang berlaku untuk penafsiran, kecuali apabila hukum setempat yang bersifat memaksa menentukan lain.
